{"id":2173,"date":"2018-08-07T16:16:13","date_gmt":"2018-08-07T10:46:13","guid":{"rendered":"http:\/\/allgujaratnews.in\/?p=2173"},"modified":"2018-08-07T14:21:31","modified_gmt":"2018-08-07T08:51:31","slug":"2173-2","status":"publish","type":"post","link":"https:\/\/allgujaratnews.in\/en\/2173-2\/","title":{"rendered":"Donations to Regional Political Parties"},"content":{"rendered":"<p><\/p>\n<p style=\"font-weight: 400;\"><strong>Analysis of Donations declared by Regional Political Parties \u2013 FY 2016-17<\/strong><\/p>\n<p style=\"font-weight: 400;\">This report, prepared by\u00a0<strong>Association for Democratic Reforms<\/strong>\u00a0(ADR) focuses on donations declared by Regional Political Parties, during the Financial Year 2016-17, as submitted by the parties to the Election Commission of India (ECI).<\/p>\n<p style=\"font-weight: 400;\">Details of\u00a0<strong><u>sources of income of Regional Parties<\/u>\u00a0<\/strong>and\u00a0<strong><u>sector-wise donations<\/u>\u00a0<\/strong>(from known sources) will be released on\u00a0<strong><u>9<sup>th<\/sup>\u00a0Aug, 2018.<\/u><\/strong><\/p>\n<p style=\"font-weight: 400;\">\u00a0<em><u>For details of\u00a0<strong>top donors<\/strong>\u00a0and\u00a0<strong>donations from foreign countries<\/strong>, refer to the Annexures in the English report, attached herewith.<\/u><\/em><\/p>\n<h2>Executive Summary<\/h2>\n<p style=\"font-weight: 400;\">The\u00a0<strong>executive summary\u00a0<\/strong>below lists the key observations drawn from the report:<\/p>\n<ol>\n<li style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong><u>Donations to Regional Parties as declared to the ECI (FY 2016-17)<\/u><\/strong><\/li>\n<li style=\"font-weight: 400;\">Under\u00a0<strong>Section 29C(1) of the Representation of People\u2019s Act, 1951,\u00a0<\/strong>political parties are required to prepare a report providing details of contributions\u00a0<strong>in excess of twenty thousand rupees<\/strong>\u00a0from any person in a particular financial year to avail 100% tax exemption. However, in FY 2016-17, we see that\u00a0<strong>7 Regional\u00a0<\/strong>Parties (SAD, MGP, DMK, AINRC, AGP, NPF and DMDK)<strong>\u00a0<\/strong>have also provided details of donations received\u00a0<strong>below Rs 20,000<\/strong>\u00a0in their contributions report.<\/li>\n<li style=\"font-weight: 400;\">The total amount of donations declared by Regional Parties, including both above and below Rs 20,000, was<strong>Rs 91.37 cr<\/strong>, from\u00a0<strong>6339 donations.<\/strong><\/li>\n<li style=\"font-weight: 400;\">\u00a0With regard to the total amount of donations,<strong>Shiv Sena\u00a0<\/strong>leads with\u00a0<strong>Rs 25.65 cr\u00a0<\/strong>from 297 donations followed by\u00a0<strong>AAP<\/strong>, which has declared receiving\u00a0<strong>Rs 24.73 cr\u00a0<\/strong>from 3865 donations.<strong>SAD<\/strong>\u00a0declared receiving\u00a0<strong>Rs 15.45 cr\u00a0<\/strong>that is the third highest amongst all regional parties.<\/li>\n<li style=\"font-weight: 400;\"><strong>72.05%<\/strong>\u00a0or\u00a0<strong>Rs 65.83 cr<\/strong>\u00a0of the total donations received by Regional Parties have been received solely by top three Regional Parties.<\/li>\n<li style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong><u>Comparison of donations received by Regional Parties between FY 2015-16 and FY 2016-17<\/u><\/strong><\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong><u>\u00a0<\/u><\/strong><\/p>\n<ol start=\"17\">\n<li style=\"font-weight: 400;\"><strong>AGP, SAD, JDS, MNS<\/strong>\u00a0and\u00a0<strong>AAP<\/strong>\u00a0saw the maximum percentage increase in their income from donations between FY 2015-16 and 2016-17.<\/li>\n<li style=\"font-weight: 400;\">Donations to\u00a0<strong>AGP\u00a0<\/strong>increased by<strong>\u00a07183%,\u00a0<\/strong>followed by\u00a0<strong>SAD\u00a0<\/strong>for which it was<strong>\u00a05842%,\u00a0<\/strong>and\u00a0<strong>JDS\u00a0<\/strong>that saw an increase of<strong>\u00a0596%<\/strong>.<\/li>\n<li style=\"font-weight: 400;\">Amongst the top five parties, only\u00a0<strong>Shiv Sena\u00a0<\/strong>saw a decline in the donations received from FY 2015-16. The donations that it had received in FY 2015-16, declined by\u00a0<strong>70%<\/strong>\u00a0or\u00a0<strong>Rs 61.19 cr\u00a0<\/strong>in FY 2016-17.<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong><u>\u00a0<\/u><\/strong><\/p>\n<p style=\"font-weight: 400;\">\u00a0\u00a0III.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong><u>Cash donations declared by the Regional Parties \u2013 FY 2016-17<\/u><\/strong><\/p>\n<p style=\"font-weight: 400;\">ECI\u00a0<a href=\"http:\/\/eci.nic.in\/eci_main1\/PolPar\/Transparency\/Guidelines_29082014.pdf\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/eci.nic.in\/eci_main1\/PolPar\/Transparency\/Guidelines_29082014.pdf&amp;source=gmail&amp;ust=1533717825296000&amp;usg=AFQjCNEBNURF-MEvJItGcK-ZADdE0e6vUw\"><strong>notification dated 29<sup>th<\/sup>\u00a0August, \u201914<\/strong><\/a>\u00a0stated that \u201c<strong><em>\u2026no tax deduction shall be allowed on the contributions made in cash by any person or company to a political party\u201d.<\/em><\/strong>\u00a0This notification was applicable for donations made from FY 2014-15 onwards. But, the Regional Parties have declared receiving Rs 2.82 cr via donations in cash.<\/p>\n<ol start=\"91\">\n<li style=\"font-weight: 400;\">Out of the total donations of\u00a0<strong>Rs 91.37 cr\u00a0<\/strong>declared by the Regional Parties,\u00a0<strong>Rs 2.82 cr<\/strong>\u00a0from\u00a0<strong>1919 donations<\/strong>\u00a0was received in cash during FY 2016-17. This formed\u00a0<strong>3.09%\u00a0<\/strong>of the\u00a0<strong>total donations\u00a0<\/strong>to the parties.<\/li>\n<\/ol>\n<ol start=\"41\">\n<li style=\"font-weight: 400;\"><strong>Maximum<\/strong>\u00a0<strong>donations in cash<\/strong>\u00a0was declared by\u00a0<strong>AINRC,<\/strong>\u00a0which collected a total of\u00a0<strong>Rs 65 lakhs,\u00a0<\/strong>followed by\u00a0<strong>AGP\u00a0<\/strong>with\u00a0<strong>Rs 41.2 lakhs\u00a0<\/strong>and\u00a0<strong>NPF\u00a0<\/strong>with\u00a0<strong>Rs 41 lakhs.<\/strong><\/li>\n<\/ol>\n<ol start=\"72\">\n<li style=\"font-weight: 400;\">Among all the states, donors from\u00a0<strong>Assam\u00a0<\/strong>made the highest donations of\u00a0<strong>Rs 72.7 lakhs\u00a0<\/strong>in cash followed by donors from\u00a0<strong>Puducherry\u00a0<\/strong>who donated a total of\u00a0<strong>Rs 65.3 lakhs\u00a0<\/strong>in cash.<\/li>\n<\/ol>\n<ol start=\"17\">\n<li style=\"font-weight: 400;\"><strong>Donations worth Rs 60 lakhs in cash did not have address details. 6 Regional Parties (NPF, MGP, DMK, BPF, Shiv Sena and AGP)\u00a0<\/strong>have received such donations in FY 2016-17. (Refer: Annexure 1)<\/li>\n<\/ol>\n<ol>\n<li style=\"font-weight: 400;\">\u00a0<strong><u>State-wise donations to Regional Parties<\/u><\/strong><\/li>\n<\/ol>\n<ol>\n<li style=\"font-weight: 400;\">\u00a0<strong>Segregation of donations according to location\u00a0<\/strong>was made by\u00a0<strong>ADR<\/strong>\u00a0based on the\u00a0<strong>addresses\u00a0<\/strong>provided by the parties in their donations report to the ECI.<\/li>\n<\/ol>\n<ol>\n<li style=\"font-weight: 400;\">\u00a0\u00a0<u>Donations declared by the Regional Parties contained details of donations received from 29 States\/Union Territories\/common capitals and 27 countries according to the declared address of donors.<\/u>Only AAP declared donations from abroad.<\/li>\n<\/ol>\n<ol start=\"20\">\n<li style=\"font-weight: 400;\">\u00a0Regional parties have declared receiving the highest amount of money or<strong>Rs 20.86 cr\u00a0<\/strong>from\u00a0<strong>Delhi<\/strong>, followed by\u00a0<strong>Rs 19.7 cr\u00a0<\/strong>from\u00a0<strong>Maharashtra\u00a0<\/strong>and\u00a0<strong>Rs 9.42 cr<\/strong>\u00a0from\u00a0<strong>Punjab<\/strong>.<\/li>\n<\/ol>\n<ol start=\"14\">\n<li style=\"font-weight: 400;\">\u00a0<strong>35.67%<\/strong>or\u00a0<strong>Rs 8.82 cr<\/strong>\u00a0of the total declared donations to<strong>\u00a0AAP\u00a0<\/strong>was received from\u00a0<strong>abroad<\/strong>. (Refer: Annexure- 2)<\/li>\n<li style=\"font-weight: 400;\">\u00a0\u00a0A total of<strong>Rs 14.38 cr,\u00a0<\/strong>(15.74% of total donations received by the Regional parties, FY 2016-17)<strong>, could not be attributed to any State\/Union Territory due to<\/strong>\u00a0<strong>incomplete or lack of information provided by the parties.<\/strong><\/li>\n<li style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong><u>Disclosure of PAN details in donations<\/u><\/strong><\/li>\n<\/ol>\n<ol>\n<li style=\"font-weight: 400;\">Out of 25 Regional Parties who had declared receiving donations,<strong>\u00a018 parties<\/strong>, have\u00a0<strong>declared donations of donors without their PAN details.<\/strong><\/li>\n<\/ol>\n<ol start=\"23\">\n<li style=\"font-weight: 400;\"><strong>\u00a0Rs 23.08 cr\u00a0<\/strong>or\u00a0<strong>25.26%\u00a0<\/strong>of the total amount of donations received by Regional Parties\u00a0<strong>do not have PAN details<\/strong>.<\/li>\n<\/ol>\n<ol start=\"8\">\n<li style=\"font-weight: 400;\">It is to be noted that parties like\u00a0<strong>BPF, MGP, PMK, RJD<\/strong>\u00a0and\u00a0<strong>ZNP<\/strong>\u00a0who have declared 100 percent donations,\u00a0<strong>have<\/strong>\u00a0<strong>not provided PAN details of even a single donor\u00a0<\/strong>in their donations statement.<\/li>\n<li style=\"font-weight: 400;\">It is seen that\u00a0<strong>AAP\u00a0<\/strong>declared receiving\u00a0<strong>Rs 8.82 cr from abroad<\/strong>\u00a0out of which\u00a0<strong>PAN details are not available<\/strong>\u00a0for donations amounting to\u00a0<strong>Rs 8.32 cr<\/strong>.<\/li>\n<\/ol>\n<h2>Recommendations<\/h2>\n<ol>\n<li style=\"font-weight: 400;\">The Supreme Court gave a judgment on September 13, 2013 declaring that no part of a candidate\u2019s affidavit should be left blank.
