Analysis of Donations declared by Regional Political Parties \u2013 FY 2016-17<\/strong><\/p>\n

This report, prepared by\u00a0Association for Democratic Reforms<\/strong>\u00a0(ADR) focuses on donations declared by Regional Political Parties, during the Financial Year 2016-17, as submitted by the parties to the Election Commission of India (ECI).<\/p>\n

Details of\u00a0sources of income of Regional Parties<\/u>\u00a0<\/strong>and\u00a0sector-wise donations<\/u>\u00a0<\/strong>(from known sources) will be released on\u00a09th<\/sup>\u00a0Aug, 2018.<\/u><\/strong><\/p>\n

\u00a0For details of\u00a0top donors<\/strong>\u00a0and\u00a0donations from foreign countries<\/strong>, refer to the Annexures in the English report, attached herewith.<\/u><\/em><\/p>\n

Executive Summary<\/h2>\n

The\u00a0executive summary\u00a0<\/strong>below lists the key observations drawn from the report:<\/p>\n

    \n
  1. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Donations to Regional Parties as declared to the ECI (FY 2016-17)<\/u><\/strong><\/li>\n
  2. Under\u00a0Section 29C(1) of the Representation of People\u2019s Act, 1951,\u00a0<\/strong>political parties are required to prepare a report providing details of contributions\u00a0in excess of twenty thousand rupees<\/strong>\u00a0from any person in a particular financial year to avail 100% tax exemption. However, in FY 2016-17, we see that\u00a07 Regional\u00a0<\/strong>Parties (SAD, MGP, DMK, AINRC, AGP, NPF and DMDK)\u00a0<\/strong>have also provided details of donations received\u00a0below Rs 20,000<\/strong>\u00a0in their contributions report.<\/li>\n
  3. The total amount of donations declared by Regional Parties, including both above and below Rs 20,000, wasRs 91.37 cr<\/strong>, from\u00a06339 donations.<\/strong><\/li>\n
  4. \u00a0With regard to the total amount of donations,Shiv Sena\u00a0<\/strong>leads with\u00a0Rs 25.65 cr\u00a0<\/strong>from 297 donations followed by\u00a0AAP<\/strong>, which has declared receiving\u00a0Rs 24.73 cr\u00a0<\/strong>from 3865 donations.SAD<\/strong>\u00a0declared receiving\u00a0Rs 15.45 cr\u00a0<\/strong>that is the third highest amongst all regional parties.<\/li>\n
  5. 72.05%<\/strong>\u00a0or\u00a0Rs 65.83 cr<\/strong>\u00a0of the total donations received by Regional Parties have been received solely by top three Regional Parties.<\/li>\n
  6. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Comparison of donations received by Regional Parties between FY 2015-16 and FY 2016-17<\/u><\/strong><\/li>\n<\/ol>\n

    \u00a0<\/u><\/strong><\/p>\n

      \n
    1. AGP, SAD, JDS, MNS<\/strong>\u00a0and\u00a0AAP<\/strong>\u00a0saw the maximum percentage increase in their income from donations between FY 2015-16 and 2016-17.<\/li>\n
    2. Donations to\u00a0AGP\u00a0<\/strong>increased by\u00a07183%,\u00a0<\/strong>followed by\u00a0SAD\u00a0<\/strong>for which it was\u00a05842%,\u00a0<\/strong>and\u00a0JDS\u00a0<\/strong>that saw an increase of\u00a0596%<\/strong>.<\/li>\n
    3. Amongst the top five parties, only\u00a0Shiv Sena\u00a0<\/strong>saw a decline in the donations received from FY 2015-16. The donations that it had received in FY 2015-16, declined by\u00a070%<\/strong>\u00a0or\u00a0Rs 61.19 cr\u00a0<\/strong>in FY 2016-17.<\/li>\n<\/ol>\n

      \u00a0<\/u><\/strong><\/p>\n

      \u00a0\u00a0III.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Cash donations declared by the Regional Parties \u2013 FY 2016-17<\/u><\/strong><\/p>\n

      ECI\u00a0notification dated 29th<\/sup>\u00a0August, \u201914<\/strong><\/a>\u00a0stated that \u201c\u2026no tax deduction shall be allowed on the contributions made in cash by any person or company to a political party\u201d.<\/em><\/strong>\u00a0This notification was applicable for donations made from FY 2014-15 onwards. But, the Regional Parties have declared receiving Rs 2.82 cr via donations in cash.<\/p>\n

        \n
      1. Out of the total donations of\u00a0Rs 91.37 cr\u00a0<\/strong>declared by the Regional Parties,\u00a0Rs 2.82 cr<\/strong>\u00a0from\u00a01919 donations<\/strong>\u00a0was received in cash during FY 2016-17. This formed\u00a03.09%\u00a0<\/strong>of the\u00a0total donations\u00a0<\/strong>to the parties.<\/li>\n<\/ol>\n
          \n
        1. Maximum<\/strong>\u00a0donations in cash<\/strong>\u00a0was declared by\u00a0AINRC,<\/strong>\u00a0which collected a total of\u00a0Rs 65 lakhs,\u00a0<\/strong>followed by\u00a0AGP\u00a0<\/strong>with\u00a0Rs 41.2 lakhs\u00a0<\/strong>and\u00a0NPF\u00a0<\/strong>with\u00a0Rs 41 lakhs.<\/strong><\/li>\n<\/ol>\n
            \n
          1. Among all the states, donors from\u00a0Assam\u00a0<\/strong>made the highest donations of\u00a0Rs 72.7 lakhs\u00a0<\/strong>in cash followed by donors from\u00a0Puducherry\u00a0<\/strong>who donated a total of\u00a0Rs 65.3 lakhs\u00a0<\/strong>in cash.<\/li>\n<\/ol>\n
              \n
            1. Donations worth Rs 60 lakhs in cash did not have address details. 6 Regional Parties (NPF, MGP, DMK, BPF, Shiv Sena and AGP)\u00a0<\/strong>have received such donations in FY 2016-17. (Refer: Annexure 1)<\/li>\n<\/ol>\n
                \n
              1. \u00a0State-wise donations to Regional Parties<\/u><\/strong><\/li>\n<\/ol>\n
                  \n
                1. \u00a0Segregation of donations according to location\u00a0<\/strong>was made by\u00a0ADR<\/strong>\u00a0based on the\u00a0addresses\u00a0<\/strong>provided by the parties in their donations report to the ECI.<\/li>\n<\/ol>\n
                    \n
                  1. \u00a0\u00a0Donations declared by the Regional Parties contained details of donations received from 29 States\/Union Territories\/common capitals and 27 countries according to the declared address of donors.<\/u>Only AAP declared donations from abroad.<\/li>\n<\/ol>\n
                      \n
                    1. \u00a0Regional parties have declared receiving the highest amount of money orRs 20.86 cr\u00a0<\/strong>from\u00a0Delhi<\/strong>, followed by\u00a0Rs 19.7 cr\u00a0<\/strong>from\u00a0Maharashtra\u00a0<\/strong>and\u00a0Rs 9.42 cr<\/strong>\u00a0from\u00a0Punjab<\/strong>.<\/li>\n<\/ol>\n
                        \n
                      1. \u00a035.67%<\/strong>or\u00a0Rs 8.82 cr<\/strong>\u00a0of the total declared donations to\u00a0AAP\u00a0<\/strong>was received from\u00a0abroad<\/strong>. (Refer: Annexure- 2)<\/li>\n
                      2. \u00a0\u00a0A total ofRs 14.38 cr,\u00a0<\/strong>(15.74% of total donations received by the Regional parties, FY 2016-17), could not be attributed to any State\/Union Territory due to<\/strong>\u00a0incomplete or lack of information provided by the parties.<\/strong><\/li>\n
                      3. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Disclosure of PAN details in donations<\/u><\/strong><\/li>\n<\/ol>\n
                          \n
                        1. Out of 25 Regional Parties who had declared receiving donations,\u00a018 parties<\/strong>, have\u00a0declared donations of donors without their PAN details.<\/strong><\/li>\n<\/ol>\n
                            \n
                          1. \u00a0Rs 23.08 cr\u00a0<\/strong>or\u00a025.26%\u00a0<\/strong>of the total amount of donations received by Regional Parties\u00a0do not have PAN details<\/strong>.<\/li>\n<\/ol>\n
                              \n
                            1. It is to be noted that parties like\u00a0BPF, MGP, PMK, RJD<\/strong>\u00a0and\u00a0ZNP<\/strong>\u00a0who have declared 100 percent donations,\u00a0have<\/strong>\u00a0not provided PAN details of even a single donor\u00a0<\/strong>in their donations statement.<\/li>\n
                            2. It is seen that\u00a0AAP\u00a0<\/strong>declared receiving\u00a0Rs 8.82 cr from abroad<\/strong>\u00a0out of which\u00a0PAN details are not available<\/strong>\u00a0for donations amounting to\u00a0Rs 8.32 cr<\/strong>.<\/li>\n<\/ol>\n

                              Recommendations<\/h2>\n
                                \n
                              1. The Supreme Court gave a judgment on September 13, 2013 declaring that no part of a candidate\u2019s affidavit should be left blank. Similarly,\u00a0no part of the Form 24A submitted by political parties providing details of donations above Rs 20,000 should be blank<\/strong>.<\/li>\n
                              2. The National and Regional Parties should, ideally,\u00a0lead by example<\/strong>\u00a0by filing\u00a0complete and correct statements<\/strong>\u00a0of donations to the ECI\u00a0well in time<\/strong>\u00a0for public scrutiny so as to encourage financial transparency.<\/li>\n
                              3. Parties\u00a0not adhering<\/strong>\u00a0to the deadline fixed by the Election Commission of India should be\u00a0penalized<\/strong>\u00a0by making them\u00a0liable to pay tax on 100% of their income<\/strong>\u00a0from various sources.<\/li>\n
                              4. The National and Regional political parties must provide all information on their finances under the Right to Information Act.<\/strong>\u00a0This will go a long way in strengthening political parties, elections and democracy.\"\" \"\" \"\" \"\" \"\" \"\"<\/li>\n<\/ol>\n
