બનાસકાંઠા જિલ્લાના મુખ્ય મથક પાલનપુરના એરોમા હાઇવે સર્કલ પર ટ્રાફિક જામ એ વર્ષો જૂની સમસ્યા છે. લોકો હાઇવે સર્કલ પર કલાકો સુધી ટ્રાફિકમાં ફસાય છે. જે સમસ્યાનો નિવેડો લાવવા માટે સરકારે બાયપાસ મંજૂર કરી જમીન સંપાદન હાથ ધર્યું હતું. પાલનપુરના 40 હજાર લોકોને માટેનો આ પ્રશ્ન 15 વર્ષથી છે. 50 હજાર વાહનો નોંધાયેલાં છે. અહીં રોજના 70 હજાર વાહનો પસાર થતાં હોવાની ધારણા છે.
પાલનપુર શહેરમાં ટ્રાફિકની સમસ્યા હળવી કરવા માટે અહીં રાષ્ટ્રીય ધોરીમાર્ગ માટે બાયપાસ માર્ગ બનાવવા માટે રૂ. 300 કરોડનો પ્રોજેક્ટ હાથ ધરવામાં આવ્યો છે. ધોરીમાર્ગ બનાવવા માટે જમીન સંપાદન કરવામાં આવી રહી છે. જમીનનું વળતર આપવા માટે સરકારે રૂ. 80 કરોડ નક્કી કર્યા છે.
પાલનપુર શહેરની ફરતે માર્ગ અને મકાન વિભાગ દ્વારા 24 કિલોમીટર લાંબા ચાર માર્ગીય બાયપાસ બનાવનો છે. પશ્ચિમ દિશા તરફના બાયપાસ માટે એક રેલવે ઓવરબ્રિજ, એક નદી પરનો બ્રિજ અને જમીન સંપાદન કામગીરી માટેની દરખાસ્ત બનાવીને સરકારે મંજૂર કરી હતી.
બાયપાસ માટે 60થી 100 મીટર જમીન સંપાદન કરવા જાહેરનામું બહાર પાડવામાં આવ્યું હતું. ખેડૂતોએ તેનો વિરોધ કરતાં તે 30 મીટર કરવામાં આવ્યું હતું.
150 હેક્ટર જમીન 60 મીટર પ્રમાણે થતી હતી. જે 30 મીટરનો થતાં હવે 75 હેક્ટર (185 એકર) જમીન સંપાદન કરવાની છે. બાયપાસ હાઇવે ટચ જમીનોના ભાવ વધી ગયો છે.
તેમાં 15 ગામોના ખેડૂતોની કિંમતી જમીન જાય છે. પાલનપુરના જગાણાથી ખેમાણા ટોલનાકા પહેલાં 24 કિલોમીટર લાંબા બાયપાસમાં 75 હેકટર જમીન સંપાદન કરવાની થશે.
16 ગામોના સરવે નંબર પંચાયતને સોંપાયા હતા. ખેડૂત ખાતેદારોને પંચાયતમાં તલાટીએ મળવા બોલાવીને જમીન સંપાદન કરીને સરકારને આપવા માટે કહ્યું હતું. જમીન સંપાદન માટેના સર્વે નંબર અને ગામના નકશા જાહેર કર્યા હતા.
પાલનપુર સીટી બાયપાસ માટે મોટી જમીન સંપાદન કરવામાં આવતી હોવાથી ખેડૂતોને વાંધો હતો. જેમાં 50 ખેડૂતો જમીન વિહોણા બની જાય છે. તેથી જમીન સંપાદન 30 મીટર કરવામાં આવ્યું હતું. કિસાન સંઘના બનાસકાંઠાના પ્રમુખ માવજી લોહે વિરોધ કર્યો હતો.
જમીન સંપાદન કરવા સામે ખેડૂતો આંદોલન કરી રહ્યા છે. જમીન મેળવવા સામે વિરોધ કરીને કલેકટરને આવેદનપત્ર આપી ખેડૂતોને પૂરતું વળતર આપવા માંગણી કરી હતી. મોં માગ્યું વળતર ન આપવું હોય તો સામે એવી જ જમીન આપવા માંગણી હતી.
ખેડૂતોએ વિરોધ કરતાં કામ ખોરંભે પડી ગયું હતું.
મહેસુલ વિભાગે ફેબ્રુઆરી 2024માં જાહેરનામા બહાર પાડ્યા હતા જેમાં જમીન સંપાદન અંગે નિયમ બતાવેલો છે તેમાં શરત 3માં સ્પષ્ટ કહ્યું છે કે, નોંધણીમાં ફેરફાર કરવા કે નામ બદલા નહીં. જો તેમ થશે તો વળતર મૂલ્યાંકન વખતે તે ફેરફાર ધ્યાનમાં લેવાશે નહીં.
આમ જમીનને બિનખેતી કરી ત્યારે તે અધિકારી જાણતાં હતા તે જાહેરનામું અને પ્લાન તૈયાર કરાયા છે.
આવા 33 હેક્ટર જમીન છે, જેમાં ગોલમાલ કરીને સરકારને કરોડો રૂપિયાનું નુકસાન કરીને ભ્રષ્ટાચાર કરવામાં આવ્યો છે.
સામે જમીન આપો એવી માંગણી કરવામાં આવી હતી. ખેડૂતો આત્મહત્યા કરશે.
અધિકારીઓ બિનખેતી કરવાનું કામ કરવા માટે 2થી 3 વર્ષ લેતાં હોય છે તે કામ 20થી 25 દિવસમાં પૂરું કરી દીધું હતું. કેટલાક અધિકારીઓ અને રાજકીય નેતાઓએ ભાગીદારીમાં જમીનો લઈ લીધી છે.
બિન ખેતી થઈ જતાં તેનો ભાવ 4થી 10 ગણો વધી ગયો છે. તેથી સરકારે 4થી 10 ગણું વળતર ચૂકવવું પડશે.
એન એ કરી દીધા બાદ બાકીનું કામ 11 મહિનામાં પૂરું કરી દીધું હતું. હવે વળતરનું ખર્ચ 180 કરોડ થઈ જશે.
2022માં 380 કરોડ રૂપિયાનો પ્રોજેક્ટ હતો જે હાલ રૂ. 600થી 700 કરોડનો થઈ ગયો છે. તેથી હવે સવાલ એ આવીને ઊભો છે કે પ્રોજેક્ટ થશે ખરો.
ગામોની જમીન બિનખેતી કરાવી
જગાણા, ભાગળ, વાસણા, ભાવિસણા, સાગ્રોસણા, વેડંચા, એંગોલા, ખોડલા, ચડોતર, પખાણવા, મલાણા, લુણવા, મોરીયા, દેલવાડા, સોનગઢ દેમોની જમીન મેળવવા માટે ડેસેમ્બર 2023 અને જાન્યુઆરી 2024માં જમીન મેળવવા જાહેરનામું બહાર પાડવામાં આવ્યા જેની ખેતીની જમીન બિનખેતી કરી હતી.
માર્ગ બનાવનો પ્લાન તૈયાર કરાયો તે પહેલાં આ ગામની જમીનો બિનખેતી કરવાની માંગણી કલેક્ટર પાસે આવી ન હતી. પ્રોજેક્ટનો નકશો તૈયાર થયો તેની સાથે જ આ જમીનો બિનખેતી કરી આપવા એકાએક અરજીઓ આવવા લાગી હતી.
અનેક નિયમોનો ભંગ કલેક્ટર દ્વારા થયો છે.
જેમાં આ 15 ગામની 75 જમીનો માટે અસામાન્ય ઝડપે ખેતીની જમીન બિન ખેતી કરી દેવામાં આવી છે.
માર્ગ અને મકાન વિભાગે ઓછા ખર્ચે પ્રોજેક્ટ તૈયાર કરવા ડિઝાન કરી તેનો અંદાજ સરકારને આપ્યો હતો. જે રૂ. 80 કરોડ જેવો હતો. પણ ખેતીની જમીનમાં જે વળતર આપવાનું થતું હતું કે રાતોરાત બિનખેતીની જમીન કરી દેવાનું કૌભાંડ થતાં તેનો વળતરનો ખર્ચ વધીને રૂ.200થી 250 કરોડ થઈ ગયો છે.
જમીન એન એ કરવા માટે રૂ. 50 કરોડ ખેડૂતો પાસેથી પડાવવામાં આવ્યા હોવાનું માનવામાં આવે છે. જેમાં રૂ. 50 કરોડનો ભ્રષ્ટાચાર થયો હોવાનું માનવામાં આવે છે. સરકારને રૂ. 200 કરોડના ખાડામાં કલેક્ટર કચેરીએ ઉતારી દીધી છે.
આમ, અગ્રતાક્રમ રાખીને હેતુફેર કરેલી જમીનમાં મોટા કૌભાંડો થયા છે. ખેડૂતોને 4 ગણી રકમ અપાશે. જેમાં કેટલાક અધિકારીઓ અને રાજકીય વ્યક્તિઓનો અડધો ભાગ હોવાનું માનવામાં આવે છે.
સરકારે એક વર્ષની ફાઈલોની તપાસ કરવા માટે માંગણી કરી છે. માર્ગ મકાન વિભાગનો ગુપ્ત પ્લાન ખેડૂતો સુધી એકાએક કઈ રીતે પહોંચી ગયો તેની તપાસની માંગણી કરવામાં આવી છે.
વિકાસ નકશો વિવાદમાં
પાલનપુર શહેરનો વિકાસ નકશો 10 વર્ષથી બની રહ્યો છે. 3 વખત મંજૂરી માટે સરકારમાં મોકલવામાં આવ્યો હતો. ગાંધીનગર વિકાસ કમિશ્નરે પરત મોકલતાં રહ્યાં છે. ડી પી રોડમાં છેડછાડ કરવામાં આવી હોવાની ફરિયાદો હતી. 80 વાંધા હતા. ગણેશપુરાના ખેડૂતોએ મંગળવારે પાલિકા કચેરીએ આવી હંગામો મચાવ્યો હતો, તેમજ આવેદનપત્ર આપી ડીપી રોડ નામંજૂર કરવા રજૂઆત કરી હતી. ગેરરીતિ કરવાની ફરિયાદો ઉઠી હતી. જેના પગલે ભાજપ તેમજ પાલિકાના કેટલાક પદાધિકારીઓ દ્વારા તે વિકાસ નકશો રદ કરવા મુખ્યમંત્રી સુધી રજૂઆત કરવામાં આવી હતી. વિકાસ નકશો 2014માં મંજૂર થવો જોઈતો હતો, 2024માં મંજૂર થયો નથી.
15 ગામોમાં ચોરસ મીટરના રૂ. 1500થી 3500 ભાવ છે. જો બાયપાસ બની જતાં બે ગણા ભાવ થઈ શકે છે. અહીંથી રોજના 50 હજાર વાહનો પસાર થશે જે પાલનપુરમાં નહીં જાય, તેથી આ માર્ગનું મહત્વ વધી જશે.
અહીં સરવે કરીને એક મહિનાથી ખુંટ લાગી ગયા છે. કેટલાક ખેડૂતોનો વિવાદ ચાલુ છે. તે કલેક્ટરે ટકવા દીધો નથી. હવે અહીં પુલ બનાવવા, પગે ચાલીને કે ગામના લોકો વાહન લઈને માર્ગને ઓળંગવા માટે અંડરપાસ કેટલાં બને છે તે જોવાનું છે. અહીં એક અંદાજ પ્રમાણે 20 અંડરપાસ અને 3 હવાઈ પુલ બની શકે છે. વરસાદી પાણીના નાળા બનાવવા પડશે. ખેડૂતોના ખેતરમાં પાણી ન ભરાઈ રહે તે માટે 50 જેવા નાના નાળા કે પાઇપ નાખવા પડશે.
24 કિલોમીટરના માર્ગ માટે હવે રૂ. 300 કરોડનું ટેન્ડર બહાર પાડવામાં આવશે.
હવે અહીં મોટા પાયે વૃક્ષો કાપવાના આદેશ કરાશે.
સરકારે કોઈ વળતર જાહેર કર્યું નથી તેની ચૂકવણી કરી નથી. પણ અહીં 160 કરોડ રૂપિયા 115 સરવે નંબર માટે આપવામાં આવશે. રૂ. 80 કરોડ પ્રમાણે એક સરવે નંબરને સરેરાશ રૂ. 55 લાખ ચૂકવવામાં આવે તેવી શક્યતા છે. બિનખેતીના 45 સરવે નંબરોને રૂ.2 કરોડ સરેરાશ આપવામાં આવે એવી શક્યતા જોવામાં આવી રહી છે.
એક નિયમ એવો છે કે, કોઈ પણ હાઈવે કે માર્ગની પહોળાઈ 150થી 200 મીટર હોવી જોઈએ. પણ પાલનપુરમાં તે પહોળાઈ કેટલીક જગ્યાએ વધારે છે. જે જમીનોમાં ગોટાળા કરવા માટે વધારે પહોળાઈ રાખવામાં આવી હોવાનું માનવામાં આવે છે.
જમીનોના ગોટાળા થયા છે તેની લીંક પાલનપુરથી લઈને ગાંધીનગરના માર્ગ અને મકાન તથા મહેસુલ વિભાગ સુધી જોડાઈ રહી છે.
જાણભેદુ કેટલાક લોકોએ અહીં પહેલાંથી જ સસ્તામાં જમીન લીધી છે. પછી જાહેરનામું બહાર પડ્યું હતું. જે માર્ગ બની જતાં ઘણી કિંમત મેળવશે. માર્ગમાં જશે તો પણ અને નહીં જાય તો તે વેપારી ભાવે વેચાશે.
જાહેરનામું બહાર પાડવાનો વિલંબ કરીને અહીં મોટા પાયે જમીનના સોદા થયા છે. તેથી સરકારે તપાસ કરવી જોઈએ.
અહીં રાજ હીત અને જનહીત જોવાયું નથી. અધિકારી અને નેતાઓનું હીત વધારે જોવામાં આવ્યું છે. તેથી સરકારે આ માર્ગ પરની જમીન અંગે તપાસ કરવી જોઈએ. 25 કિલોમીટરમાં 115 સરવે નંબર આવે છે. તેમાંથી 60 ટકા જમીન પહેલા લેવાઈ ગઈ છે.
મલાણાથી શરૂ થાય છે ત્યાંથી પાલનપુલ, સોનગઢ, ચોડોતર, ભાવિસ્ણા, વાસણા, દેલવાડા જેવા ગામોના મોટા સોદા થયા છે.

The work was disrupted due to the protest of the farmers.
The Revenue Department issued a notification in February 2024 which laid down the rules regarding land acquisition and clearly stated in condition 3, there will be no change in registration or change in name. If yes, then the change will not be taken into account while evaluating the compensation.

इसमें 15 गांवों के किसानों की कीमती जमीन जाती है। पालनपुर के जगणा से खेमाणा टोल रोड तक 24 किमी लंबे बाइपास में 75 हेक्टेयर जमीन का अधिग्रहण करना होगा.
16 गांवों के सर्वे नंबर पंचायत को सौंपे गए। तलाटी ने पंचायत में किसानों की एक बैठक बुलाई और उनसे जमीन अधिग्रहण कर सरकार को देने को कहा। भूमि अधिग्रहण के लिए सर्वे नंबर और गांव के नक्शे जारी किए गए।
किसानों ने विरोध किया क्योंकि पालनपुर सिटी बाईपास के लिए एक बड़ी भूमि का अधिग्रहण किया जा रहा था। जिसमें 50 किसान भूमिहीन हो गये. इसलिए भूमि अधिग्रहण 30 मीटर किया गया। किसान संघ बनासकांठा के अध्यक्ष मावजी लोह ने विरोध जताया.
किसान जमीन अधिग्रहण के खिलाफ आंदोलन कर रहे हैं. उन्होंने जमीन अधिग्रहण का विरोध करते हुए कलेक्टर को आवेदन देकर किसानों को पर्याप्त मुआवजा देने की मांग की है. मुआवजा नहीं देना था तो बदले में वही जमीन मांगी गई।
किसानों के विरोध के कारण कार्य बाधित हो गया।
राजस्व विभाग ने फरवरी 2024 में एक अधिसूचना जारी की जिसमें भूमि अधिग्रहण के संबंध में नियम निर्धारित किए गए और शर्त 3 में स्पष्ट रूप से कहा गया, पंजीकरण में कोई बदलाव या नाम में बदलाव नहीं होगा। यदि हां, तो मुआवजे का मूल्यांकन करते समय परिवर्तन को ध्यान में नहीं रखा जाएगा।
इस प्रकार, घोषणा और योजना तैयार की गई है जो अधिकारी को तब पता थी जब भूमि बंजर थी।
33 हेक्टेयर ऐसी जमीन है, जिसमें सरकार को करोड़ों रुपये का नुकसान पहुंचाकर भ्रष्टाचार किया गया है.
इसके बदले में जमीन देने की मांग की गयी. किसान आत्महत्या कर लेंगे.
अधिकारियों ने वह काम 20 से 25 दिनों में पूरा कर लिया, जिसमें गैर-खेती के काम में 2 से 3 साल लग जाते थे. कुछ अधिकारियों और नेताओं ने साझेदारी में जमीनें ले रखी हैं।
इसकी खेती न होने से इसकी कीमत 4 से 10 गुना तक बढ़ गई है। तो सरकार को 4 से 10 गुना तक मुआवजा देना होगा.
N करने के बाद शेष कार्य 11 माह में पूरा हुआ। अब मुआवजे की कीमत 180 करोड़ होगी.
2022 में 380 करोड़ का प्रोजेक्ट जो फिलहाल रु. 600 से 700 करोड़ रु. तो अब सवाल ये है कि क्या ये प्रोजेक्ट होगा.
गाँवों की भूमि को बंजर कर दिया गया
दिसंबर 2023 और जनवरी 2024 में जगना, भागल, वासना, भविसना, सग्रोसाना, वेदांचा, अंगोला, खोडला, चडोतर, पखिनवा, मलाणा, लुनवा, मोरिया, देलवाड़ा, सोनगढ़ डेमो में भूमि अधिग्रहण के लिए भूमि अधिग्रहण नोटिस जारी किए गए। .
सड़क निर्माण योजना तैयार होने से पहले इस गांव की जमीनों को अकृषित करने की मांग कलेक्टर के पास नहीं आई थी. जैसे ही परियोजना का नक्शा तैयार हुआ, अचानक इन जमीनों को बंजर करने के अनुरोध आने लगे।
कलेक्टर द्वारा कई नियमों का उल्लंघन किया गया है.
जिसमें इन 15 गांवों की 75 जमीनें असामान्य गति से बंजर हो गई हैं।
सड़क एवं भवन विभाग ने कम लागत पर प्रोजेक्ट तैयार कर सरकार को एस्टीमेट दिया. जो कि रु. यह 80 करोड़ जैसा था. लेकिन रातोरात गैर कृषि योग्य भूमि परिवर्तन के घोटाले के कारण कृषि भूमि में जो मुआवजा मिलता था, उसे बढ़ाकर 200 से 250 करोड़ रुपये कर दिया गया है।
भूमि एन ए रु. माना जा रहा है कि किसानों से 50 करोड़ रुपये की उगाही की गई है। जिसमें रु. माना जा रहा है कि 50 करोड़ का भ्रष्टाचार हुआ है। सरकार रु. कलेक्टर कार्यालय द्वारा 200 करोड़ रुपए गिराए गए हैं।
इस प्रकार, प्राथमिकता के लिए निर्धारित भूमि में बड़े पैमाने पर घोटाले हुए हैं। किसानों को 4 गुना राशि दी जाएगी. जिसमें कुछ अधिकारियों और राजनीतिक हस्तियों का हिस्सा माना जा रहा है.
सरकार ने एक साल की फाइलों की जांच की मांग की है. इसकी जांच की मांग की गयी है कि पथ निर्माण विभाग की गुप्त योजना अचानक किसानों तक कैसे पहुंच गयी.
विवाद में विकास मानचित्र
पालनपुर शहर का विकास मानचित्र 10 वर्षों से बन रहा है। इसे तीन बार मंजूरी के लिए शासन को भेजा गया। गांधीनगर विकास आयुक्त इसे वापस भेज रहे हैं. डीपी रोड में छेड़छाड़ की शिकायतें मिल रही थीं। 80 आपत्तियां आईं। गणेशपुरा के किसानों ने मंगलवार को नगर निगम कार्यालय पर ऐसा हंगामा किया और याचिका भी लगाई।
डीपी रोड को अस्वीकृत करने का प्रस्ताव दिही. गड़बड़ी की शिकायतें थीं. नतीजा यह हुआ कि भाजपा और नगर पालिका के कुछ पदाधिकारियों ने विकास मानचित्र को निरस्त करने की मांग मुख्यमंत्री को सौंपी। विकास मानचित्र 2014 में स्वीकृत होना चाहिए था, 2024 में स्वीकृत नहीं हुआ।
15 गांवों में प्रति वर्ग मीटर रु. 1500 से 3500 है कीमत. अगर बाइपास हुआ तो कीमत दोगुनी हो सकती है. यहां से रोजाना 50 हजार वाहन गुजरेंगे जो पालनपुर नहीं जाएंगे, इसलिए इस सड़क का महत्व बढ़ जाएगा।
यहां एक माह से सर्वे चल रहा है। कुछ किसान अभी भी विवाद में हैं. कलेक्टर ने इसे टिकने नहीं दिया. अब पुल बनाने के लिए देखें कि पैदल सड़क पार करने के लिए या ग्रामीणों को सड़क पार करने के लिए कितने अंडरपास बनाए जाते हैं। एक अनुमान के मुताबिक, यहां 20 अंडरपास और 3 फ्लाईओवर बनाए जा सकते हैं। बरसाती पानी की नालियाँ बनानी होंगी। किसानों के खेतों में जलजमाव रोकने के लिए 50 छोटी नालियां या पाइप बिछाना है.
24 किमी सड़क के लिए अब रु. 300 करोड़ का टेंडर जारी होगा.
अब यहां बड़े पैमाने पर पेड़ काटने के आदेश दिए जाएंगे.
सरकार ने न तो कोई मुआवज़ा घोषित किया है और न ही भुगतान किया है. लेकिन यहां 115 सर्वे नंबर के लिए 160 करोड़ रुपए दिए जाएंगे. रु. प्रति सर्वेक्षण संख्या औसतन 80 करोड़ रु. 55 लाख का भुगतान होने की संभावना है. 45 गैर-कृषि सर्वेक्षण नंबरों के लिए औसतन 2 करोड़ रुपये का आकलन किया जा रहा है।
नियमानुसार कोई भी हाईवे या सड़क 150 से 200 मीटर चौड़ी होनी चाहिए। परंतु पालनपुर में कुछ स्थानों पर वह चौड़ाई अधिक है। माना जाता है कि ज़मीनें धोखाधड़ी के लिए खुली रखी गई हैं।
जमीन घोटाले की कड़ी पालनपुर से लेकर गांधीनगर रोड और बिल्डिंग व राजस्व विभाग तक जुड़ रही है.
कुछ अनजान लोगों ने पहले ही यहां सस्ती जमीन खरीद ली है। फिर अनाउंसमेंट जारी किया गया. जिसका सड़क बनने पर काफी मूल्य मिलेगा। सड़क पर चले तो भी और नहीं तो भी व्यावसायिक मूल्य पर बिकेगा।
अधिसूचना जारी होने में देरी से यहां बड़े पैमाने पर जमीन के सौदे हुए हैं। इसलिए सरकार को जांच करानी चाहिए.
राज हीट और जान हीट यहां नजर नहीं आ रहे हैं. अफसरों और नेताओं की दिलचस्पी ज्यादा देखी गई है. इसलिए सरकार को इस मार्ग की जमीन की जांच करानी चाहिए. 25 किमी में 115 सर्वे नंबर आते हैं। उसमें से 60 फीसदी जमीन पहले ही ली जा चुकी है.
मलाणा से शुरू होकर पालनपुल, सोनगढ़, चोडोतर, भाविसना, वासना, देलवाड़ा जैसे गांवों को बड़ी डील मिली है।
