People of 8 states have got justice. But, for 10 years, Prime Minister Narendra Modi could not get justice to the state of Gujarat. Neither could the Supreme Court do so. The independent and mixed governments of the then Chief Minister Narendra Modi and the BJP have lasted for 35 years. But BJP could not get justice either. BJP had promised the public in their election manifesto and during the elections that they will give a local High Court Bench other than Ahmedabad. But every time after coming to power, it is forgotten. In 2022 also BJP President CR Patil did the same.

Ahmedabad is the only High Court of Gujarat.

Three zones
2.25 crore people of South Gujarat, 2 crore people of Saurashtra and 10 lakh people of Kutch for the establishment of a permanent bench of Gujarat High Court. In 4 regions of Gujarat, benches of Gujarat High Courts have not been provided despite the dire need. Other 8 states have more than one High Court, so why not in Gujarat. Pending case

Currently 1 lakh 70 thousand cases are pending in the High Court. In which 1 lakh 15 thousand are civil cases. There are 54 thousand criminal cases. If it is taken in 4 parts of Gujarat, then 48 thousand cases can be from each part. In which there are areas of South Gujarat, North Gujarat, Kutch, Saurashtra.

16 lakh cases are pending in the lower courts of Gujarat. There are 21 thousand cases in the High Court for 10 years. More than 200 cases are more than 25 years old. In which lakhs of man hours are wasted in travel.

Injustice in justice

It is in the interest of justice that women, backward people, poor and people from rural areas and tribal areas come to the nearest High Court. Because people from remote areas travel 400 to 800 kilometers to come and go. So a person spends Rs. The cost of 1 gift is less. Poor people do not have the money to go to Ahmedabad High Court once every two months for years.

Expensive monopoly fees

33 percent of the people of Gujarat are poor. 70 percent of the people cannot afford expensive fees and charges. Since Ahmedabad has a monopoly, many lawyers charge lakhs of rupees. They charge a hefty fee ranging from 5 lakhs to 25 lakhs. Therefore, it is necessary to establish 4 permanent benches of Gujarat High Court. There are High Court benches in 8 states of the country. Karnataka, Rajasthan, Tamil Nadu, Madhya Pradesh. Despite having a geographically smaller area and less population than Gujarat, Assam has 6 permanent benches.

Although Gujarat is fifth in terms of geographical area and ninth in terms of population in India, it has not been given any bench. This is injustice to the public. It is the right of the people. Our democracy is such that if the public has a will, the government and the High Court have to accept their demand.

Since people have to go to remote areas, the time taken in the case increases, so the case is not disposed of quickly. Therefore, the rate of pending cases in ordinary courts is the highest in Gujarat at 9.51 years. While in the High Court it is 3.3 years, which is 7th in the country. Since this is a very serious matter, a bench of the High Court is inevitable to reduce the years of pending cases in subordinate courts and the Gujarat High Court.

If lower courts will increase, why not the High Court?

When the Gujarat High Court was established in 1961, there were 12 courts in Ahmedabad which have increased to 43 today. Therefore, there should be another 3 benches of the High Court. Justice is equal for all.

There are 35 judges in the High Court. The number of approved judges is 52. The court is currently running with fewer judges.

The burden of salary can be reduced. At present, the average salary of a High Court judge is Rs. 2 lakhs. If 9 new judges of 3 batches are given, then there will be no burden of more salary.
