Ref: My letter to various departments regarding Construction & Demolition waste

Management rules 2016’,

Demanding:

· To return fine of Rs 8, 69, 850/- collected from 85 taxpaying citizens of Baroda for removal of Construction and demolition waste till Provisions for Handling and Processing Construction and Demolition waste management are made as per guidelines under C & D waste management rules 2016.

· Request to clear all debris dumped by VMC and private Builders near ravines of Vishvamitri, water Bodies and Kaans.

· Immediately stop dumping of debris, nr Nizampura Pumping Station and Pratapgunj nr Bhukhi Kaans.

· Expedite Implementation of Construction and Demolition waste management rules 2016.

· Urgently remove municipal, other waste dumped into ravines of Vishvamitri river, lakes & many Kaans in Vadodara

· Subsequent letter from Department of Urban development, GOG dated 7 July, 2018, VMC/802018/4125/P

& letter from VMC ref: SWMO: 414/18/8/2018 dated 18/8/2018.

Resp Sir,

After reading in Newspaper that in past eleven days fine of Rs 8,69,850 /- has been collected from 85 taxpaying citizens of Baroda from about various sites for removal of Construction & demolition waste. More than 83 persons have been fined for the same.I had written a letter to various concerned departments and Yourself demanding implementation of C & D waste rules 2016 demanding the following

Demand with regards to Construction & Demolition waste management rules 2016’

· To return fine of Rs 8, 69, 850/- collected from 85 taxpaying citizens of Baroda for removal of Construction and demolition waste till Provisions for Handling and Processing Construction and Demolition waste management are made as per guidelines under C & D waste management rules 2016.

· Request to clear all debris dumped by VMC and private Builders near ravines of Vishvamitri, water Bodies and Kaans.

I am sorry to mention that I did not receive any reply to the mail from VMC till it was forced to do by the Urban Development Department vide its letter dated 7 July, 2018.

Sir Enclosed please fid the reply sent by Add. City Engineer from VMC regarding the same.

The contents in this letter are a contradictory and a lie.

1. Its mentioned in this letter that, the fine is charged as per provisions in the Budget Manual,

· Sir I personally called the helpline no. provided they had no idea of the amount to be charged for collection of debris,

· I was then told to contact Sanitation Officer in ward from there.

· Upon checking with ward officer He said that there is no criteria for the same and that they do not collect any charges for clearing the Debris.

2. Sir, I am being officially told that VMC has not dumped any debris in water bodies or in ravines of Vishvamitri, Sir then where does all this debris collected go? As in letter itself its mentioned that there is no facility to process C & D waste at present in VMC.

3. As far as intentions are concerned its written that VMC is serious about setting up Processing facility for C & D waste, But this is where the intention ends, the tender were opened before 8 months and VMC is sitting on it since then?

4. As far as Stating that VMC has not dumped any debris Nr Bhukhi Kaans Nr Tulsi Hotel and Nizamura APS is concerned it’s a lie , as I am myself been told by EX Engg , Ward 7 several times that this is their identified dumping site, and it has not been cleared inspite of several representation in Zonal meetings, and to Municpal Commissioner on SMS and verbal too. I have even sent pictures of the same and have many times raised it in General Board also.

5. The guidelines issued by VMC on 27/1/2016 is an internal letter within VMC and citizens are not aware of any such rules?

6. I maintain that if VMC has no system to dispose C & D waste scientifically how can you collect fine? Pl refund the same.

7. Even GPCB has issued a notice post my letter that VMC should clear all the debris from ravines of Vishvamitri and water bodies of the city.

Sir would appreciate that VMC accepts its negligence and delay in implementing C & D rules 2016 and instead of such lame excuses and replies the facility for processing he same as per provisions in the rules is created at the earliest.
