ગુજરાતમાં ઔદ્યોગિક અકસ્માતો નિવારવા અને સલામત કાર્યસ્થળ ઉભા કરીને કામદારોના મોત થતા અટકાવો

ઔદ્યોગિક રાજ્ય ગુજરાતમાં 182 ગુજરાત ઈન્ડસ્ટ્રીયલ ડેવલપમેન્ટ કોર્પોરેશનની વસાહતો – GIDC, 7 સ્પેશ્યલ ઇકોનોમિક ઝોન (SEZ) અને 11 સ્પેશ્યલ ઇન્વેસ્ટમેન્ટ રીજીયન (SIR) આવેલા છે. 40 હજાર ઉદ્યોગો આવેલા છે. એટલે, આગ અને બ્લાસ્ટના બનાવો પરત્વે ખાસ સાવચેતી રાખવાની જરૂરીયાત છે. ફેબ્રુઆરી 2020 થી ડીસેમ્બર 2020ના દસ મહિનાના ટૂંકા ગાળામાં ગુજરાતમાં આગના અને અકસ્માતોના 14 બનાવો નોધાયા છે. 45 લોકોના મોત તેમજ અસંખ્ય લોકો ઈજાગ્રસ્ત થયા છે.
9 ડિસેમ્બર, 2020ની મોડી રાત્રે અમદાવાદના વટવા-વિન્જોલ રેલ્વે ફાટક પાસે આવેલી માતંગી એન્ટરપ્રાઈઝ અને જક્ષય નામની કેમિકલ કંપનીમાં ભીષણ આગ ફાટી નીકળી હતી. જેમાં આસપાસની 4 મળી કુલ 6 જેટલી કંપનીમાં આગ ફેલાઈ હતી.
રાજ્યમાં સતત આગના અને અકસ્માતના બનાવો બનતા રહ્યા છે. અસંખ્ય માનવો અને પશુ પંખીઓનો ભોગ લેવાયો છે. પર્યાવરણની અસંતુલીતતા જોખમાઈ રહી છે.
પર્યાવરણ મિત્રએ રાજ્યના માનનીય મુખ્યમંત્રીને પત્ર લખીને અપીલ કરી છે.

પર્યાવરણ મિત્ર છેલ્લા ૨૩ વર્ષથી ગુજરાતમાં પર્યાવરણ જાળવણી, પર્યાવરણીય શિક્ષણ અંગે લોક જાગૃતિ ફેલાવવાનું કામ કરે છે. રાષ્ટ્રીય અને આંતરરાષ્ટ્રીય સ્તરે પર્યાવરણીય કાયદાઓના મુસદ્દા અને અંતરરાષ્ટ્રીય સંધિઓમાં જરૂરી સૂચનો કરે છે, પર્યાવરણ મિત્રને સંયુક્ત રાષ્ટ્રસંઘે ઇકોસોક ફોરમમાં સ્પેશ્યલ કન્સલટેટીવ સ્ટેટસ આપ્યું છે. પર્યાવરણ મિત્ર છેલ્લા ૧૦ વર્ષથી કલાયમેટ ચેન્જ માટે યોજાતી શિખર પરિષદોમાં સક્રિય રીતે સહભાગી બને છે. UNFCCCના ઓબ્ઝર્વર તરીકેની ભૂમિકા અદા કરે છે, ભારત સરકારના ઇન્ડિયા પેવેલિયનમાં છેલ્લી બે શિખર પરિષદમાં (COP-૨૪, બોન-જર્મની અને COP-૨૫ મેડ્રીડ-સ્પેન) પર્યાવરણ મિત્રના પ્રતિનિધિને વ્યાખ્યાનો આપવાની તક મળી છે. પર્યાવરણ મિત્ર અવારનવાર નીતિ વિષયક બાબતોમાં રાજ્ય સરકાર અને કેન્દ્ર સરકારનું ધ્યાન દોરે છે.
ઉદ્યોગોમાં અકસ્માતો અને આગ લાગવાના બનાવો રોકવા માટે સરકારે નીચે મુજબનાં નિર્દેશો સંલગ્ન વિભાગોને આપવાની જરૂર છે.
- સમગ્ર રાજ્યમાં એક ઝુંબેશ ઉપાડવામાં આવે અને જોખમી રસાયણોનો સંગ્રહ કરતા ગેરકાયદેસર ગોડાઉનોની તપાસ કરીને તે બંધ કરાવવા જોઈએ.
- તમામ ઔદ્યોગિક એકમોએ ફાયર સેફટી અંગેનું NOC લીધું છે કે નહિ તે ચકાસીને જો ના લીધું હોય તો તેવા ઔદ્યોગિક એકમને તાત્કાલિક અસરથી બંધ કરી દો.
- કેટલાક ઔદ્યોગિક એકમોએ ફાયર સેફટી અંગેની NOC લીધી હોય છે પરંતુ તે લાયસન્સની અવધિ પૂરી થવા છતાં પણ રીન્યુ કરાવતા નથી. તાત્કાલિક ધોરણે આ રીન્યુ કરે તેવી ઝુંબેશ ઉઠાવવી જોઈએ અને ફાયર સેફટીનું લાયસન્સ દર વર્ષે રીન્યુ કરાવવું ફરજીયાત બનાવો.
- ગુજરાતની તમામ ૧૮૨ GIDC તથા SEZ અને SIR આવ્યા છે ત્યાં ફરજીયાતપણે ફાયર સેફટી અંગે તાલીમ કેન્દ્રો ઉભા કરો. દર છ મહિને પ્રત્યેક ઔદ્યોગિક એકમોનો ફાયર સેફ્ટીના કામમાં જોડાયેલ અધિકારી કે કર્મચારી રીફ્રેશર તાલીમ મેળવે તેવું આયોજન કરો (તાજેતરમાં જે આગના બનાવો બન્યા છે તેના ઉપરથી તારણ નીકળે છે કે, ફાયર સેફ્ટીના સાધનો ઉપલબ્ધ છે પણ ઓપરેટ નહિ કરી શકવાને લીધે આગના બનાવો બન્યા).
- જે ઉદ્યોગો બંધ પડ્યા છે તે ઉદ્યોગોમાં જો કોઈ જોખમી રસાયણો સંગ્રહાયેલા હોય તો તાકીદે તેનો નિકાલ કરવો જોઈએ.
- બંધ પડેલા ઉદ્યોગો જે છે તેમાં જો કોઈ પ્રકારનો ગેસ ટાંકીઓમાં હોય તો તેનો પણ નિકાલ કરવો જોઈએ. (ગુજરાતમાં અનુભવ એવો છે કે, બંધ પડેલા ઉદ્યોગોની ટાંકીઓમાંથી ગેસ લીકેજ થયા છે અને નુકસાન થયું છે)
- રાજ્યમાં લાંબા સમયથી અગ્નિશમન દળ, પ્રદૂષણ નિયંત્રણ બોર્ડ અને ફેક્ટરી ઇન્સ્પેકશનના વિવિધ વિભાગોમાં ખાલી કર્મચારી, અધિકારીઓની જગ્યા તાકીદે ભરવામાં આવે અને જવાબદારી સુનિશ્ચિત કરવામાં આવે.
રાજ્ય સરકાર સમક્ષ અમારી આ મુજબની ભલામણો છે :
- રાજ્ય સરકારે જિલ્લાવાર એક કાયમી સમિતિની રચના કરવી જોઈએ જે જ્યારે અકસ્માત, આગ કે પ્રદૂષણના બનાવો બને ત્યારે કેવા પ્રકારનું નુકસાન થયું છે તેની આકારણી કરે, અસરગ્રસ્ત લોકો સાથે સુનાવણી કરે અને ત્યારબાદ જે-તે જીલ્લા મેજીસ્ટ્રેટને પોતાનો અહેવાલ આપે. જેના પર જીલ્લા મેજીસ્ટ્રેટ વળતર આપવાના હુકમો કરી શકે તથા પર્યાવરણીય સંબંધિત થયેલ નુકસાન બાબતે ગુજરાત પ્રદૂષણ નિયંત્રણ બોર્ડનું ધ્યાન દોરે જેથી પર્યાવરણીય નુકસાનની ભરપાઈ થઇ શકે.
- અગાઉ ગુજરાતની નામદાર વડી અદાલતે SPECIAL CIVIL APPLICATION No. 9699 of 2008- સોલંકી જસવંતસિંહ કાળુસિંહ Vs જીલ્લા કલેકટરના કેસમાં એક સમિતિ રચવાનો નિર્દેશ કર્યો હતો. જેમાં (1) District Collector, (2) Members of GPCB, (3) Secretaries of Forest and Environment Department, (4) Irrigation and Water Resources Department, (5) Animal Husbandry Department, (6) President of Gram Panchayat/Municipality or their representatives ના સભ્યો હોય. આ સમિતિ નુકસાનીનો અભ્યાસ કરીને જીલ્લા મેજીસ્ટ્રેટને પોતાનો અહેવાલ રજૂ કરે અને તે મુજબ જીલ્લા મેજીસ્ટ્રેટ વળતર અંગેનો એવોર્ડ નક્કી કરે.
આવી રીતે કાયમી ધોરણે એક સમિતિ જે અમે પેરેગ્રાફ એકમાં લખ્યું છે તે પ્રમાણે નિયુક્ત કરવાનો ભારપૂર્વકનો આગ્રહ છે.
- ગુજરાત પ્રદૂષણ નિયંત્રણ બોર્ડ જયારે પ્રદૂષણ કે અકસ્માતો થાય તેવી કસૂરવાર કંપનીઓ/ઉદ્યોગો/ફેકટરીઓ/ઔદ્યોગિક એકમો પાસેથી એન્વાયરોમેન્ટલ ડેમેજ કોમ્પેનસેશન (EDC) ની માતબર રકમ ઉઘરાવે છે આ EDC રકમનો ઉપયોગ જે-તે કંપની દ્વારા થયેલા પર્યાવરણીય નુકસાન માટે વાપરવા અંગેની પદ્ધતિ વિકસાવવી જરૂરી છે.
- જ્યારે જ્યારે મોટી ઔદ્યોગિક હોનારત થાય છે ત્યારે સરકાર દ્વારા તપાસ સમિતિનું ગઠન કરવામાં આવે છે પરંતુ આ તપાસ સમિતિના અહેવાલ પબ્લિક ડોમેઈનમાં મૂકવામાં નથી આવતા. અમારી માંણી છે કે, આવા રિપોર્ટો જાહેર કરવા જોઈએ.
- મુદ્દા નંબર ચારમાં રજૂ કરેલ તપાસપંચોએ કરેલ ભલામણો કે નિર્દેશોનું અમલીકરણ થાય તે માટેનું મોનીટરીંગ મીકેનીઝમ ગોઠવવાની જરૂર છે. ખાસ કરીને ડીઝાસ્ટર મેનેજમેન્ટ ઓથોરીટી, ઔદ્યોગિક સલામતી અને સ્વાસ્થ્ય વિભાગ તથા પ્રદૂષણ નિયંત્રણ બોર્ડની સંકલન સમિતિ દર છ મહિને મળે અને અમલીકરણ અંગે માહિતી મેળવીને જરૂરી પગલા ભરવા નિર્દેશ કરે.
આ ભલામણો અને સૂચનોને આપ ધ્યાનમાં લેશો અને આપણા ગુજરાત રાજ્યને ઔદ્યોગિક અકસ્માતોથી મુક્ત, સલામત રાજ્ય બનાવવાની દિશામાં ત્વરિત કાર્યવાહી કરશો તેવી અપેક્ષા છે.

Prevent industrial accidents in Gujarat and prevent workers’ deaths by establishing safe workplaces

Gujarat Industrial Development Corporation has 182 – GIDC, 7 Special Economic Zones (SEZ) and 11 Special Investment Zones (SIR). There are 40 thousand industries. Therefore, special attention needs to be taken against fire and explosion incidents. In a short span of ten months from February 2020 to December 2020, there have been 14 incidents of fire and accidents in Gujarat. 45 people have died and many has been injured.
On late night of December 9, 2020, a chemical fire called Matakshi Enterprise, a chemical company called Zakshya near the Vatva-Vinjol railway gate in Ahmedabad, caught fire. A total of 6 companies were burnt to ashes in the fire.
Fires and accidents are frequent in the state. Countless human and animal birds have been killed. The imbalance of the environment is in danger.
Paryavaran Mitra has appealed in a letter to the Chief Minister of the state.

Paryava Mitra has been working for the last 23 years to spread awareness about environmental protection and environmental education in Gujarat. Drafting environmental laws nationally and internationally and making necessary recommendations in international treaties, the Environment Friend has been accorded special advisory status by the United Nations in the EcoSo Forum. Been an active participant in the Climate Change Summit for over 10 years. UNFCCC acts as Observer.
The government is required to give the following instructions to the departments concerned to prevent accidents and fires in industries.
- A campaign should be launched across the state to stop illegal warehouses storing hazardous chemicals.
- Check if all industrial units have taken NOC on fire protection and if not, shut down the industrial unit with immediate effect.
- Some industrial units have taken a No Objection Certificate on fire protection, but have not renewed the license even after its expiry. A campaign should be launched to renew it on an immediate basis and make it compulsory to renew the fire protection license every year.
- Compulsory fire protection training centres have been established in all 182 GIDCs and SEZs and SIRs of Gujarat. Arrange for every officer or employee involved in the fire safety work of each industrial unit to undergo refresher training every six months (fire protection equipment is available due to recent fire incidents, but is not able to operate).
- If any hazardous chemical industries are closed, they should be cleaned immediately.
- Any gas in the tanks of closed industries should be disposed of.
- Long vacancies in various departments of fire brigade, pollution control board and factory inspection should be filled immediately. Accountability must be ensured.
We have the following recommendations before the state government:
- The state government should form a district-wise standing committee to assess the type of damage caused in the event of an accident, fire or pollution, hold a hearing with the affected people and then report to the district magistrate. On which the District Magistrate can issue compensation orders and draw attention of the Gujarat Pollution Control Board regarding environmental damage so as to compensate for the environmental damage.
- Special Civil Application No. 9699 of 200899- Solanki directed the Gujarat High Court to form a committee in the case of Jaswant Singh Kalusinh vs District Collector. In which (1) District Collector, (2) Member of GPCB, (3) Secretary of Forest and Environment Department, (4) Department of Irrigation and Water Resources, (5) Animal Husbandry Department, (6) President of Gram Panchayat or Municipality or Become a member of their representatives. This committee will study the loss and submit its report to the District Magistrate and accordingly the District Magistrate will decide the compensation.
- Gujarat Pollution Control Board collects the amount of Environmental Damage Compensation (EDC) only from industries, factories, industrial units responsible for pollution, accidents. Which needs to be used to compensate for environmental damage.
- Whenever a major industrial disaster occurs, an inquiry committee is formed by the government but the report of this inquiry committee is not kept in the public domain. We demand that such reports be made public and released.
- There is a need to put in place a monitoring mechanism for the implementation of recommendations or directives made by the Commission of Inquiry submitted. In particular, the Coordination Committee of the Disaster Management Authority, the Department of Industrial Safety and Health and the Pollution Control Board should meet every six months and instruct them to take necessary steps by obtaining information about the implementation.
You are expected to heed these recommendations and suggestions and take immediate action to make your state of Gujarat free from industrial accidents.

औद्योगिक राज्य में गुजरात, औद्योगिक विकास निगम की 182 बस्तियाँ हैं – GIDC, 7 विशेष आर्थिक क्षेत्र (SEZ) और 11 विशेष निवेश क्षेत्र (SIR)। 40 हजार उद्योग हैं। इसलिए, आग और विस्फोट की घटनाओं के खिलाफ विशेष ध्यान रखने की आवश्यकता है। फरवरी 2020 से दिसंबर 2020 तक दस महीनों की छोटी अवधि में, गुजरात में आग और दुर्घटनाओं की 14 घटनाएं हुई हैं। 45 लोग मारे गए हैं और कंई घायल हो गए हैं।
9 दिसंबर, 2020 की देर रात को मातंगी एंटरप्राइज, अहमदाबाद में वटवा-विनजोल रेलवे फाटक के पास जक्षय नामक एक रासायनिक कंपनी में भीषण आग लग गई। आग में कुल 6 कंपनि की फेक्टरी जल कर राख हो गई।
राज्य में आग और दुर्घटनाएं लगातार हो रही हैं। अनगिनत मानव और पशु पक्षी मारे गए हैं। पर्यावरण का असंतुलन खतरे में पड़ रहा है।
पर्यावरण मित्र ने राज्य के मुख्यमंत्री को एक पत्र में अपील की है।

पर्यावरण मित्र गुजरात में पर्यावरण संरक्षण और पर्यावरण शिक्षा के बारे में जागरूकता फैलाने के लिए पिछले 23 वर्षों से काम कर रहे हैं। पर्यावरण कानूनों को राष्ट्रीय और अंतर्राष्ट्रीय रूप से प्रारूपित करना और अंतर्राष्ट्रीय संधियों में आवश्यक सिफारिशें करना, पर्यावरण मित्र को संयुक्त राष्ट्र द्वारा इकोसो फोरम में विशेष परामर्शदात्री दर्जा दिया गया है। 10 वर्षों से जलवायु परिवर्तन शिखर सम्मेलन में सक्रिय भागीदार रहे हैं। UNFCCC ऑब्जर्वर के रूप में कार्य करते है।
सरकार को उद्योगों में दुर्घटनाओं और आग को रोकने के लिए संबंधित विभागों को निम्नलिखित निर्देश देने की आवश्यकता है।
- खतरनाक रसायनों का भंडारण करने वाले अवैध गोदामों को रोकने के लिए राज्य भर में एक अभियान चलाया जाना चाहिए।
- जांचें कि क्या सभी औद्योगिक इकाइयों ने अग्नि सुरक्षा पर एनओसी लिया है और यदि नहीं, तो तत्काल प्रभाव से औद्योगिक इकाई को बंद कर दें।
- कुछ औद्योगिक इकाइयों ने अग्नि सुरक्षा पर अनापत्ति प्रमाण पत्र ले लिया है, लेकिन इसके समाप्त होने के बाद भी लाइसेंस को नवीनीकृत नहीं किया है। इसे तत्काल आधार पर नवीनीकृत करने के लिए एक अभियान चलाया जाना चाहिए और हर साल अग्नि सुरक्षा लाइसेंस को नवीनीकृत करना अनिवार्य करना चाहिए।
- गुजरात के सभी 182 जीआईडीसी और एसईजेड और एसआईआर में अनिवार्य अग्नि सुरक्षा प्रशिक्षण केंद्र स्थापित किए गए हैं। प्रत्येक औद्योगिक इकाई के अग्नि सुरक्षा कार्य में शामिल प्रत्येक अधिकारी या कर्मचारी को हर छह महीने में पुनश्चर्या प्रशिक्षण से गुजरने की व्यवस्था करें (हाल ही में आग लगने की घटनाओं के कारण अग्नि सुरक्षा उपकरण उपलब्ध हैं, लेकिन संचालित नहीं हो पा रहे हैं)।
- यदि कोई खतरनाक रसायन उद्योगों बंद हो गए हैं, तो उन्हें तुरंत साफ कीया जाना चाहिए।
- बंद उद्योगों की टैंकों में किसी भी गैस का निपटान करना चाहिए।
- फायर ब्रिगेड, प्रदूषण नियंत्रण बोर्ड और फैक्ट्री निरीक्षण के विभिन्न विभागों में लंबे समय से खाली पदो को तत्काल भरा जाना चाहिए। जवाबदेही सुनिश्चित की जानी चाहिए।
राज्य सरकार के समक्ष हमारी निम्नलिखित सिफारिशें हैं:
- राज्य सरकार को दुर्घटना, आग या प्रदूषण की स्थिति में होने वाले नुकसान के प्रकार का आकलन करने के लिए जिलावार स्थायी समिति का गठन करना चाहिए, प्रभावित लोगों के साथ सुनवाई करनी चाहिए और फिर जिला मजिस्ट्रेट को रिपोर्ट करनी चाहिए। जिस पर जिला मजिस्ट्रेट मुआवजे के आदेश जारी कर सकते हैं और पर्यावरण संबंधी क्षति के बारे में गुजरात प्रदूषण नियंत्रण बोर्ड का ध्यान आकर्षित कर सकते हैं ताकि पर्यावरणीय क्षति की भरपाई की जा सके।
- विशेष नागरिक आवेदन सं। 200899 की 9699- सोलंकी ने जसवंत सिंह कलूसिंह बनाम जिला कलेक्टर के मामले में एक समिति बनाने का निर्देश गुजरात हाईकोर्ट ने दिया। जिसमें (1) जिला कलेक्टर, (2) GPCB के सदस्य, (3) वन और पर्यावरण विभाग के सचिव, (4) सिंचाई और जल संसाधन विभाग, (5) पशुपालन विभाग, (6) ग्राम पंचायत या नगर पालिका के अध्यक्ष या उनके प्रतिनिधियों के सदस्य बनें। यह समिति नुकसान का अध्ययन करेगी और अपनी रिपोर्ट जिला मजिस्ट्रेट को सौंपेगी और तदनुसार जिला मजिस्ट्रेट मुआवजे के बारे में फैसला करेंगे।
- गुजरात प्रदूषण नियंत्रण बोर्ड केवल प्रदूषण, दुर्घटनाओं के लिए जिम्मेदार उद्योगों , कारखानों , औद्योगिक इकाइयों से पर्यावरणीय क्षति क्षतिपूर्ति (EDC) की राशि एकत्र करता है। जो पर्यावरण नुकसान की पूर्ति के उपयोग करने की जरूरत है।
- जब भी कोई बड़ी औद्योगिक आपदा होती है तो सरकार द्वारा जांच समिति का गठन किया जाता है लेकिन इस जांच समिति की रिपोर्ट को सार्वजनिक डोमेन में नहीं रखा जाता है। हम मांग करते हैं कि ऐसी रिपोर्टों को सार्वजनिक किया जाए जारी किया जाना चाहिए।
- प्रस्तुत जांच आयोगों द्वारा की गई सिफारिशों या निर्देशों के कार्यान्वयन के लिए निगरानी तंत्र स्थापित करने की आवश्यकता है। विशेष रूप से, आपदा प्रबंधन प्राधिकरण की समन्वय समिति, औद्योगिक सुरक्षा और स्वास्थ्य विभाग और प्रदूषण नियंत्रण बोर्ड हर छह महीने में मिले और कार्यान्वयन के बारे में जानकारी प्राप्त करके आवश्यक कदम उठाने का निर्देश दे।
आपसे अपेक्षा की जाती है कि आप इन सिफारिशों और सुझावों पर ध्यान दें और अपने राज्य गुजरात को औद्योगिक दुर्घटनाओं से मुक्त बनाने के लिए तुरंत कार्रवाई करें।
