Why did the Wankaner municipality government have to be suspand?

On 6th August 2022, Wankaner Municipality has been super seeded by the Urban Development Department. The chambers of the office bearers including the chief were sealed. Literature including record books and resolution books were confiscated. The office of the leaders has been sealed. Due to internal strife and strife in the BJP, there was a rebellion in the BJP at that time.
The BJP had fielded 24 members in 6 wards under the leadership of Jitu Somani. All the members were elected with a good lead. BJP got the power again, the people decided to put Jitu Somani on the post of president. But BJP named against him. Hence the rebellion.
In respect of financial matters, show cause notices were given to the members of the municipality including the chairman, vice-president in June 2022 to supersede. Political disputes started. Efforts were made by the Urban Development Department to overthrow the authority. After the rift between the BJP office-bearers of Morbi district, the dispute kept on increasing.
In order to take over all the municipalities, former Chief Minister Vijay Rupani had appointed administrators in 51 municipalities of the state without election period, even if their term had expired. The chief officer was acting as the administrative head. This benefited the BJP. The BJP won 75 out of 81 municipalities.
Efforts were made by the elected members and BJP leader Jitu Somani to prevent the municipality from being superceded. The municipality has been overthrown after the transfer of the chief officer of Wankaner. The previous officer did not want to do wrong. Panchmahal has taken their place.
A huge convention of all castes was organized at Wankaner. A huge convention of Raghuvanshi society was held in Rajpar village.
The chief officer in charge of Wankaner Municipality was Sandeep Jhala.
The administrator will remain in office for the next 6 months till the general elections are held.
Firecrackers were burst by BJP functionaries Rajbha Jhala at Bazar Chowk in Wankaner as Wankaner municipality was super-seeded by the government. Sweetened each other’s mouth. The BJP said that the issue of mismanagement of the independent body has come to the notice of the government.
On the other hand Bhupendra Patel’s government has not taken any action against Morbi Municipality despite audio of corruption in Morbi Municipality. Whereas steps have been taken in Wankaner. The Wankaner municipality was a super seed on the strength of power.
Two leaders fight
Former mayor Jitu Somani has alleged that the Wankaner municipality was superseded at the behest of Rajkot MP Mohanbhai Kundaria. Somani has now come up against District President Mohan Kundaria, BJP District President Durbhav Detharia. A fight ensues between Jeetu Somani. The direct effect of which is the defeat of BJP in Morbi and Wankaner assembly seats.
In Wankaner, now a fierce battle has broken out between the two Ballias of BJP. There is no agreement between MP Mohan Kundaria and former Mayor Jitu Somani. So the political storm has also come. The condition of the party is getting worse due to the fight of ego. Jitu Somani is making derogatory allegations against Rajkot MP Mohan Kundaria. This situation hurts the party.
MP Mohan Kundaria says, I have no role, the government has acted accordingly. Raghuvanshi is not anti-social, Jitu Somani fabricates things in his own way. The report of which was given by the chief officer of the municipality to the government. It is evident that the Urban Development Department has superseded the Vankaner Municipal Corporation. I cannot interfere in the working of the government. Super seed notice was received, the officers went to the court, the big question is why they did not appear before the court despite being given three times to appear separately.
Social leader Jitu Somani made serious allegations against Rajkot MP Mohan Kundaria and said that BJP wants to destroy the Raghuvanshi community. This is the reason that despite being a corruption free municipality, this municipality has become a super seed. A video of the discussion of square percentage in Morbi Municipality went viral. Still no action is taken by the BJP leaders or the government.
The BJP stronghold in Wankaner was winning. But after the municipal elections, local BJP leaders turned against Somani. Seeds were sown to super seed the municipality.
Somani’s 15-point allegation, the real fight of BJP
Jitubhai Somani announced 15 issues in the press conference :-
Even after Mohan Kundaria tried to buy and sell the members of the municipality, a conspiracy is being hatched to remove them from power without staying with anyone.
Venkaner Municipality has the most transparent and honest administration among the 162 municipalities of Gujarat.
The notice given to us is for disqualifying the civic body without any reason.
This notice is a conspiracy to suppress my career and suppress me.
Since last 35 years Wankaner Municipality is running transparently and honestly. People have full faith in me. which I have maintained. Whereas the people of Wankaner have been an opposition free municipality for the last 15 years.
Mohan Kundaria openly tried to beat me in 2017. When Mohanlal tried hard to stop me from getting ticket in 2017 assembly elections.
Narendrabhai Modi and Amitbhai Shah and I trusted me to have an Ankaner assembly ticket. Mohanlal as an independent candidate stood up and defeated me. As Mohanlal did not get a ticket for the suggested name, he stood as an independent and helped him financially to contest the election. The party suspended him. Kundaria started the BJP again using Vaag. Party status. The rebels against the BJP are in power today. He was also given ticket in the Zilla Panchayat elections.
MP Mohan Kundaria and his accomplice-criminal Durhabji Detharia have hatched a conspiracy to kidnap the municipality. In which the CMO misled the regional leadership. The office has been directed to encroach upon the Municipality.
Even though Mohan Kundaria and Darhabji Dehariya are trying to remove me from BJP. Can’t remove me from the hearts of voters of Wankaner assembly.
The remaining details will be announced on the next date at a public meeting in Wankaner.

If the municipality has been wrongly removed. The law is being violated.
Morbi had gone from Kundaria’s hand. Morbi has lost the election from the trading panel of Marketing Yard.
Wankaner assembly will not be held because of Mohan Kundaria
From illegal construction to scams are happening inside Morbi city. In this regard, BJP state president CR Patil is demanding action against corruption.
Slogan – We will fight, yes we will kill. They will fight to the death. Let’s see who wins. right or wrong.
Corruption
The video which talks about the percentage of the husband of the woman president of Morbi Municipality and the husband of the woman president is a big proof of corruption. So he asked him a question that why Morbi Municipality is not super sided. Morbi MLA and Panchayat head is Brijesh Merja.
There is only one question among the voters of Wankaner Municipality that what is the value of our vote? In political discord, new elections will be held within a year and public money will be wasted and new elections will be held. How fair is this?
What was in the notice?
The Urban Development and Urban Housing Department has issued a show cause notice. In which the chief has done many things by going out of power. It has confirmed and given illegal orders.
The employee is immediately dismissed. Leave is denied. The decisions to be taken by the chief officer were taken by the chief himself. Also the financial accounts are not in order. The funds are also not being fully utilized for development works. A total of 14 issues including this were mentioned in the notice. Along with this, a general meeting has also been ordered to give clarification on this. When the reply was not received, the municipality was removed.
For failure to perform duty under the Municipalities Act, 1963, a show cause notice was issued to the municipality under section 263(1). The Chief Administrative Officer of that municipality cannot take any policy decision till the elections are held.
From the year 2013, the government had given a grant of Rs 54 crore. Out of which only Rs 10 crore was spent. The Chairman gave the Municipal Corporation ground for the indefinite strike to the employees.
He was getting a majority for five consecutive terms. Yet Wankaner could never get a better facility than this. In the political move of the BJP, many works including the primary facilities in the city came to a standstill. The government was not cooperating. Therefore, the residents of the city are facing many problems including roads, water and sewerage.
History
In the local government elections held in February 2021, the BJP won all 31 district panchayats, 75 out of 81 municipalities and 196 out of 321 taluka panchayats in Gujarat.
BJP won all 52 seats in Morbi municipality and 24 out of 28 seats in Wankaner municipality. Congress did not get a single seat. The Wankaner taluka panchayat was ruled by the BJP for the first time after independence.
Morbi Congress leaders joined the BJP. He was given a ticket. In which former city president Ketan Wilpara was given ticket by BJP from Ward 10. Former president of Morbi Zilla Panchayat and Congress leader Kishore Chikhlia was defected by the BJP. His wife Asmita Kishore Chikhlia has been given ticket from Dahinsara village. He has won.
There was a municipality in Gujarat, the town of Wankaner in Morbi district, where the BJP won and was still not in power. Bharatiya Janata Party candidates won 24 out of 28 seats in seven wards. The Bahujan Samaj Party (BSP) won the remaining four seats.
A meeting of municipal workers was organized by Wankaner BJP for the post of Municipal Corporation President and Vice President. In which the names of Jayshreeben Jaisukhlal Sejpal and Dharmendra Gelubha Jadeja were unanimously decided for the post of Vice President. All the members signed and gave consent letter with these two names to the city BJP President Dinu Vyas. Dinubhai Vyas had given the letter to the Parliamentary Board. CR Patil gave different names instead of fixed names. Hence the rebellion.
Dharmendra Jadeja was the vice-president of Wankaner Municipality.
Wankaner Municipality has been a BJP stronghold for the last 25 years. Due to the displeasure of the members, none of the elected members of the Bharatiya Janata Party could get the post of President-Vice President.
BJP suggested different names which hurt all the elected members. No name sent by himself 16 members dissatisfied with Vikara resigned from the BJP and rejected the party’s mandate.

Four elected members of the Bahujan Samaj Party and 11 members of the BJP voted in favor of the rebel group. 15 votes were cast in favor of the elected members while ten votes were cast in opposition. Members united against the injustice of the party and members of BJP and BSP united to make independent candidate Jayshreebehan Sejpal as president and Dharmendra Jadeja as vice-president.
BJP lost power in Wankaner municipality for the first time in 25 years.
The returning officer did not receive any complaint of disrespecting the party whip and voting against him.
Morbi District BJP President Durbhu Detharia and City BJP President Jitu Somani explained but did not understand. Somani failed to address the internal strife in the city BJP.
Loyal party workers were disappointed. These names were given for the personal benefit of some people of BJP. The BJP had to pay the price by losing the power of the municipality.
Complaint of disqualification while taking disciplinary action under Party Transfer Act. The resignations of the rebel members were not accepted.
Has been suspended from the party. BJP state president C. It was a rebellion against R. Patil. On one hand state president Chandrakant Patil and the then Chief Minister Vijay Rupani are saying that there is no division and factionalism in the BJP. But the party had to lose Morbi due to differences in the BJP.
Political parties may try to woo the representatives elected by the people for money or office and to bring down the government of the ruling party.
Many such examples have already been seen.
The law was introduced in 1985 by Rajiv Gandhi’s government to control those who switched parties after being elected. Which is included in the Tenth Schedule of the Constitution of India. It has been implemented in the whole country from 1 March 1985. If he voluntarily leaves his party after being elected, he can be prosecuted under the Defection Act.
As per the order of the Supreme Court of India, the presiding officer cannot prevent any politician from contesting elections under the Transfer of Party Act.

Four members of Bahujan Samajwadi Party resigned from Wankaner municipality in protest against the Citizenship Bill by the Central Government. Four members elected from Bahujan Samajwadi Party of Ward No. 04 namely Zakir Baloch, Sharifaben Rathor, Salim Mesania and Vijayaben Sarsa have resigned. Mayawati indirectly supported BJP in this bill by walking out of Rajya Sabha. Which was opposed in Wankaner. Expressing displeasure with Mayawati, the BSP supremo submitted the resignation of the party vice-president.

In March 2022, the Wankaner Municipal Councilor was attacked. Zakir Baloch, Shaheed Sabirbhai Baloch and Ghafarbhai Hasambhai Kabra 9 persons were attacked on the pretext of reconciliation. Zakirbhai suffered serious injuries.
This happened in Botad
In June 2022, there was a dispute among 44 members in Botad Municipality. The provincial authority took over the Botad Municipality. Of the total 44 members of Botad Municipality, 40 were from the BJP. 4 members were from Congress. Due to internal strife and factionalism among BJP members, a member of ward number 10 of the municipality was suspended from the party by the BJP on charges of indiscipline. After that all the chairpersons of the committee including the then chairman of the municipality Rajshree Vora also resigned. BJP member Alpa Sabwa contested the election against the mandate of the new president. He won by securing a majority. Rajshree Botad became the chairman of the municipality. 18 members were suspended from BJP. The functions of the Urban Development Department were removed by the new chairman citing tax evasion as well as grant returns.
The government had removed BhanVAD Municipality last year. This has been done due to the opposition of Congress and BJP.
No action against MLA
The site was acquired by Irfan Peerzada, younger brother of Mohd Javed Peerzada, Congress MLA from Wankaner, by auction in 1992 from Wankaner Municipality. After that construction work was done by him at that place. Completion certificate not received. Illegally occupied 80 feet of municipal land. Despite informing the municipality in writing, the BJP leaders did not demolish the construction.
Odd and Bharuch municipalities were thus removed 11 years ago. In March 2022, the Wankaner Municipal Councilor was attacked. Zakir Baloch, Shaheed Sabirbhai Baloch and Ghafarbhai Hasambhai Kabra 9 persons were attacked on the pretext of reconciliation. Zakirbhai suffered serious injuries.
